1. Introduction
By placing an order with LithopsPlant.com (“we,” “us,” “our”), you agree to the following Terms of Service (“Terms”). These Terms govern your purchase of plants, trees, and related products from our website, including delivery, guarantees, and other policies related to your purchase. Please read these Terms carefully before making a purchase.
2. Product Guarantee
30-Day Alive & Thrive Guarantee™
At LithopsPlant.com, we are committed to delivering healthy, thriving plants. That’s why we offer our 30-Day Alive & Thrive Guarantee™. If your plants or trees arrive in poor condition, or if they fail to thrive within the first 30 days after delivery, we will provide a one-time replacement at no additional cost.
To request coverage, please contact us at [email protected] within 24–48 hours of noticing an issue. Include your order number, photos of the plant, and a description of the problem so our team can review your case. If approved, we’ll arrange a replacement or provide another resolution to ensure your satisfaction.
Please note that plants must receive appropriate care, nutrients, and an environment suitable for their growing needs. Purchases made outside of your recommended USDA growing zone, or plants that are neglected or improperly cared for, are not eligible under this guarantee. Additionally, please ensure you follow our care instructions for the best results.
3. Shipping
Once we receive your order, we typically process and ship your plants within 1-3 business days.
Please allow extra shipping time during inclement weather or sale periods. Orders are not processed or shipped on weekends or public holidays.
We ship orders using USPS or UPS, depending on the size and weight of your purchase. Shipping costs are calculated at checkout based on the weight and volume of your items.
Once your order has shipped, we are unable to modify or cancel it. Thank you for your understanding.
4. Planting Preferences
Most plants can be safely planted year-round, but some customers may prefer to plant during warmer weather. If you need to delay the delivery of your order, please contact us at [email protected] immediately, and we will happily accommodate your preferred planting schedule.
5. Damaged Package
We take great care in packing your plants to ensure they arrive in perfect condition. However, if a package arrives with significant damage, please refuse the delivery so it can be returned to us by the carrier.
If you receive a damaged plant, do not attempt to plant it, even if you believe it might recover. Instead, contact us immediately with photos of the damage. Our team will assist you promptly and arrange for a replacement. Claims for damaged shipments must be submitted as soon as possible.
6. Refused Deliveries
If you refuse delivery of your order, and it is returned to us, a 25% restocking fee will be deducted from your refund. This fee is the same as our standard restocking fee for canceled orders. Refused deliveries require significant time and resources from our team, and plants may need to be repotted, recovered, or disposed of, depending on their condition after transit.
7. Returns
Due to the perishable nature of plants, we do not accept returns or exchanges.
Instead, our Alive & Thrive Guarantee™ covers any issues that occur within the first 30 days after delivery. For non-living items, returns are accepted within 30 days of purchase as long as they are unused and in their original packaging. Customers are responsible for return shipping costs, and no restocking fee will apply. Please contact us before sending back any items so we can provide proper instructions according to our Return Policy.
8. Order Cancellations
We understand that plans may change, and we will do our best to accommodate cancellation requests. If you need to cancel or adjust your order, please contact us within 2 hours of placing your order. We will make changes at no extra charge during this window.
After the 2-hour period, we may have already begun preparing your order, and a 25% restocking fee will apply if you cancel.
9. Assessing Plant Health
To assess if your plant is still alive, gently scrape a small section of the bark or leaves. If the layer beneath is brown or black, the plant may be dead. If it is green, the plant is likely alive and may still recover, especially if it is in dormancy. Your plant will recover as the growing season resumes.
10. Dormancy in Plants
Many plants enter dormancy from fall to early spring, a natural process that helps ease transplantation. During dormancy, plants may have fewer leaves or exhibit discoloration, but they remain healthy. This process is essential for establishing strong roots. Please note that claims for plant loss due to dormancy will not be accepted until the plant has been planted in the ground and given time to emerge from dormancy.
11. Disclaimer: Mother Nature’s Unpredictability
We cannot control environmental factors like weather, animals, or soil conditions that may affect plant health. While we strive to provide high-quality products, we encourage you to research proper planting techniques and care for your specific region, as local climate conditions significantly influence plant growth.
12. Received the Wrong Plant?
If your plant is mislabeled, we will replace it at no extra cost. Please contact us with clear pictures of the mislabeled product, and we will correct the issue.
13. Growth Rates & Plant Sizing
We provide growth rate estimates based on ideal conditions, but individual growth rates may vary depending on factors such as care and environmental conditions. The size of your plant upon arrival may differ from the mature version depicted on our website, and minor variations in size do not constitute a reason for refund or replacement. Our goal is to provide high-quality, healthy plants that will grow over time.
14. Plant Height Measurement Policy
Height measurements on our website refer to the height of the plant while still in its container, measured from the top of the rootball. After planting, the plant may appear shorter due to settling into the soil. Please measure your plant immediately upon delivery to ensure it meets your expectations.
15. Pot Sizes Explained
The container sizes for plants are based on the industry-standard trade gallon, which may differ from conventional gallon measurements. Some plants may be burlapped or pruned before shipment, which could affect their appearance upon arrival.
16. Quality and Damage Concerns
If your plant arrives damaged or beyond recovery, please contact us immediately with clear photos of the plant and box. Minor leaf loss or size discrepancies do not qualify as damage. Timely communication is critical for processing damage claims.
17. Store Credit for Non-Shippable Plants
For plants that cannot be shipped to your location due to USDA or state restrictions, we will refund the full purchase amount to your original payment method. This refund will be processed promptly, and you will receive the amount you paid for the item(s).

Please note that care instructions and plant requirements may vary based on local climate conditions. We recommend considering your region’s specific needs when selecting plants. Local agricultural offices can provide additional information on the best plants for your area.
