1. Agreement to These Terms

The website lithopsplant.com (“Lithops Plant”, the “Site”) is owned and operated by Galactic Gateway LLC, 1012 Monroe Ave, Kansas City, MO 64127, United States (“we”, “us”, “our”). By browsing the Site, creating an account or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. You agree that the information you provide (name, address, email, payment details) is accurate and complete.

3. Our Products

We sell garden seeds (flower, vegetable, fruit, herb, tree, grass and shrub seeds) and live succulent plants. We make every effort to describe and photograph our products accurately. However:

• Product photos often show mature plants. Seeds and young plants will look different, and a live plant may be smaller than the mature plant pictured.
• Plants are living things – color, shape and size can vary naturally from plant to plant.
• Growth, germination and results depend on your climate, soil, light and care, which are outside our control. Growing information on our Site is general guidance only.

4. Prices and Payment

• All prices are shown in U.S. Dollars (USD). Standard shipping within the United States is free on every order.
• Prices may change at any time, but changes do not affect orders already confirmed.
• We accept major credit and debit cards (such as Visa and Mastercard) and PayPal. Payments are processed securely by PayPal.
• If a product is listed at an obviously incorrect price because of a typing or system error, we may cancel the order and refund you in full. We will always tell you by email before cancelling.

5. Orders

After you place an order, you will receive an order confirmation email. This confirms that we have received your order; the contract is formed when we ship your items. We may refuse or cancel an order if a product is out of stock, if we cannot ship to your address, or if we suspect fraud – in these cases you will receive a full refund to your original payment method.

6. Shipping

We ship only within the United States (all 50 states and Washington, D.C.). Orders are processed within 1–3 business days and delivered within 3–7 business days by USPS or UPS. Full details are in our Shipping Policy.

7. Returns, Refunds and Guarantee

You may return eligible items within 30 days of delivery. Live plants are covered by our 30-Day Alive & Thrive Guarantee. Damaged, wrong or missing items are replaced or refunded free of charge. We do not charge restocking fees. Full details are in our Refund and Returns Policy.

8. Agricultural Restrictions

Some states restrict the import of certain plants or seeds. It is your responsibility to make sure the products you order are allowed in your state. If we cannot legally ship an item to your address, we will cancel that item and refund it in full.

9. Use of the Site

You agree not to:

• Use the Site for any unlawful or fraudulent purpose
• Try to gain unauthorized access to the Site, its servers or other users’ accounts
• Copy, scrape or resell content or products from the Site without our written permission
• Upload viruses or interfere with the normal operation of the Site
• Post false, abusive or misleading reviews

10. Accounts

If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you believe your account has been used without your permission.

11. Intellectual Property

All content on the Site – including text, product descriptions, photos, graphics, the Lithops Plant name and logo – belongs to Galactic Gateway LLC or our content suppliers and is protected by U.S. and international copyright and trademark laws. You may not use it without our written permission.

12. Reviews and Submissions

If you post a review, comment or photo on the Site, you confirm that it is your own, honest and lawful, and you give us a non-exclusive, royalty-free right to display it on the Site. We may remove content that is offensive, false or unrelated to the product.

13. Disclaimer

Except for the guarantees described in our Refund and Returns Policy, the Site and products are provided “as is”. To the extent permitted by law, we make no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Some plants and seeds may be toxic to people or pets if eaten; keep them out of reach of children and animals and check plant safety before planting edible crops near ornamental plants.

14. Limitation of Liability

To the fullest extent permitted by law, Galactic Gateway LLC will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

15. Indemnification

You agree to indemnify and hold harmless Galactic Gateway LLC and its owners and employees from any claims arising from your breach of these Terms or your misuse of the Site.

16. Termination

We may suspend or close your account, or refuse service, if you breach these Terms or use the Site fraudulently. If we terminate your access, any confirmed orders that are not affected by the breach will still be fulfilled or refunded, and the sections of these Terms about intellectual property, disclaimers, limitation of liability and governing law will continue to apply.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be handled by the state or federal courts located in Jackson County, Missouri.

18. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your personal information.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page and, for significant changes, post a notice on the Site. The version in effect when you place an order applies to that order. Continuing to use the Site after changes are posted means you accept the updated Terms.
